    Trying to remember something I read elsewhere… in common law there was a distinction in terms of penalties when it came to actions/assaults/etc that led to premature delivery. Such events that took place after the quickening led to more severe punishments. We now know that the quickening is simply when the continuous unbroken process of fetal development is able to be noticed. Yet rather than extend the protection “downward” to earlier stages of development, which would seem to be consistent with legal precedent (and science, for that matter), the supreme court went in the opposite direction and removed all protections and all distinctions.
